What is an Family Visa?

The term ‘UK family visa’ refers to a broadly defined visa route for a wide range of people who may wish to come to the UK to live with a family member for more than six months.

If you are not yet in the UK, you have the right to apply for a family visa for the UK to live with your:

  • Spouse or partner
  • Fiancé, fiancée or proposed civil partner
  • Child
  • Parent
  • Relative who will provide long-term care for you

If you only intend to visit the UK for up to six months, you may require a family visitor visa for the UK; you can check via the GOV.UK website whether this will be the case for you, or contact our immigration lawyers for further advice and guidance.

Those submitting a family visa application for the UK to care for their children are applying for what is also sometimes called the ‘parent of a British child’ visa. Meanwhile, adults who wish to move to the UK to be cared for by a relative can apply for what is often referred to as the ‘Adult Dependent Relative’, or ADR, visa.

Finally, you can also apply for a family visa for the UK on the basis of your private life. However, this route is only open to those who are already living in the UK, and is subject to other requirements.

What are the requirements for an Family Visa?

The exact UK family visa requirements that apply to you will depend on whether you are submitting an application through this visa route as a spouse, partner, parent, child, an adult coming to be cared for by a relative, or on the basis of your private life.

If, for instance, you are interested in applying for a UK family visa as a parent so that you can come to the UK to care for your child, you must first check whether you are eligible to apply for a partner. If this is indeed the case, you must apply for the partner visa rather than for the parent visa.

In the event that you are not eligible for the partner visa, and would therefore like to apply as a parent, your child must either:

  • Be under 18 on the date of your application
  • Have been under 18 when you were first granted leave and not live an independent life

Your child will be considered to be living an independent life if, for instance, they have left home, got married and had children.

In order for you to be eligible for the ‘parent of a British child’ visa, your child must also be living in the UK. In addition, one of the following must be true:

  • They’re a British or Irish citizen
  • They’ve settled in the UK – for instance, they have indefinite leave to remain, settled status or proof of permanent residence
  • They’re from the European Union (EU), Switzerland, Norway, Iceland or Liechtenstein, in addition to having pre-settled status; they must have begun living in the UK prior to 1 January 2021
  • If you’re applying while already in the UK, your child must have lived in the UK for seven years continuously, and it would not be reasonable for them to leave

If your child has settled status, you may have the option of applying to the UK Government’s free EU Settlement Scheme, or for an EU Settlement Scheme family permit. For the latest information and advice on your options, please make an enquiry to our family visa UK lawyers.

Candidates for the UK family visa as a parent also need to have sole or shared parental responsibility for their child. If you share responsibility, the child’s other parent must not be your partner. In addition, the other parent is required to either:

  • Be a British or Irish citizen
  • Have settled in the UK – for instance, they have indefinite leave to remain, settled status or proof of permanent residence
  • Be from the EU, Switzerland, Norway, Iceland or Liechtenstein, and have pre-settled status; they must have begun living in the UK prior to 1 January 2021

In the event of your child living with their other parent or carer, you will be required to have access to the child in person, as agreed with the other parent or carer or by a court order.

As aforementioned, the Adult Dependent Relative, or ADR, route is another option for those wishing to submit a family visa application for the UK.

If you are indeed an adult applying for a UK family visa so that you can come to the UK to be cared for by a relative, you are required to be outside the UK when you apply. You must also require long-term care from a parent, grandchild, brother, sister, son or daughter who is living in the UK permanently.

One of the following must also be true about the relative of the person applying for the ADR visa:

  • They’re a British or Irish citizen
  • They’ve settled in the UK – for instance, they have indefinite leave to remain, settled status or proof of permanent residence
  • They’re from the EU, Switzerland, Norway, Iceland or Liechtenstein and have pre-settled status; they are required to have begun living in the UK prior to 1 January 2021
  • They have refugee or humanitarian status in the UK

Applicants for the ADR visa are also expected to prove all of the below:

  • They require long-term care in order to do everyday household and personal tasks due to illness, disability or their age
  • The care that they require is not available or affordable in the country in which they presently live
  • The person that they will be joining in the UK will be able to support, accommodate and care for the ADR visa holder without claiming public funds for a minimum of five years
  • They are at least 18 years of age

What documents are needed for a Family Visa Application?

As an applicant for any of the aforementioned UK family visa routes, you will be expected to supply certain information and evidence to strengthen your case for the visa. Information will need to be provided for you and any dependants applying at the same time.

The Home Office will expect you to provide:

  • All your names
  • Your birthdate
  • Your current passport or other valid travel ID
  • Copies of the photo page and any visa or entry stamps in your previous passports
  • A copy of any biometric residence permit you may have
  • Details of any immigration applications you have previously made
  • Details of any criminal convictions
  • Your national insurance number, if you have one
  • Your parents’ birthdates and nationality, if you are submitting your visa application from outside the UK
  • The results of your tuberculosis test, if you are from a country where taking the test is a requirement
  • A certified translation of any document in a language other than English or Welsh

Those applying for a family visa from outside the UK must also have a blank page in their passport on which to put the visa.

In order to apply for a family visa for the UK, you will also be expected to:

  • Give proof of your finances
  • Prove your English language knowledge

Depending on your circumstances, it may be necessary for you to supply further documents for your family visa application for the UK, such as a sponsorship form from your UK-based family member.

Applicants for the UK family visa who have a partner will be asked about their partner’s name, birthdate, nationality, passport, and right to be in the UK – such as whether they are a British citizen. They will also need to provide further information about their partner, including – but not limited to – in relation to any people their partner was previously married to, and evidence of marriages ending.

In applying for a family visa for the UK, you will also be required to provide details about your children, and those of your partner, if they have any children. You will need to supply information about all of your children, even if they aren’t lodging a family visa application for the UK.

The information you will be expected to provide about your children will include:

  • Their name
  • Their nationality
  • Their birthdate
  • Their passport details
  • Who the child usually lives with
  • Any other people with parental responsibility for the child – for instance, your stepchildren’s other parents
  • The nature of your involvement in their day-to-day lives
  • Arrangements you have to see the child, such as if you have been granted access by the courts
  • The child’s extended family
  • Any countries your child has lived in or visited
